In a car accident....?

In this case it is not a question of what rights she has or doesn't have or what rights you have or do not have. You are both going to have to work it out the payment details on your own. BTW, The police did not "charge her to pay for the damage for both cars". Cops don't do that. They may have issued her a traffic citation but that has nothing to do with fault to see who pays for damages and that citation alone does not make her anymore guilty than someone that did not get a citation.
